If the recording is out of print it us up to the holder of the rights to produce more copies of it, not anyone who has a copy of the record. The difference is about the right to buy, trade, sell, destroy an individual piece of plastic as opposed to the right to re-use the "intellectual content" (to steal a phrase from academic publishing) that is contained in the grooves on the plastic without proper licensing.

Should NOT it be more unethical for yuppies to buy and sell out of print records for thousands of dollars when the sunra legacy recieves none of this money and in the mean time all I want to do is hear the music?

Why is selling your own personal property unethical? Or legally purchasing an object that you desire? Is selling used records different from selling used books, videotapes or cars? Is it only unethical if "yuppies" (who I guess have a lot of money and are just being greedy?) are doing this selling? What about old folks with big record collections who are about to go into nursing homes and need both the money and space? Should I send some money to Zenith for the 25 year old used TV I bought at a garage sale? Should Ford receive more money from me than they already got if I sell my car? Why? What makes it different for used records?

I would feel better (even if I had the money) to get a recording (especially a digital one that won't deteriorate)than to give some 'collector' a ton of cash, none of which goes to ra, allen, or any other arkestra member.

Great, go ahead and do it and send some money to the arkestra. If you do it quietly and off list, I'm sure you can manage it without getting into trouble. Many have.
